The concept 'health' is ambiguous [18,9, 11]. The concept 'mental health' is even more so. 'Health' compasses senses of well-being, wholeness, and sound ness that mean more than the simple freedom from illness - a fact appreci ated in the World Health Organization's definition of health as more than the absence of disease or infirmity [7]. The wide range of viewpoints of the con tributors to this volume attests to the scope of issues placed under the rubric 'mental health. ' (...) These papers, presented at the Fourth Symposium on Philos ophy and Medicine, were written and discussed within a broad context of interests concerning mental health. Moreover, in their diversity these papers point to the many descriptive, evaluative, and, in fact, performative functions of statements concerning mental health. Before introducing the substance of these papers in any detail, I want to indicate the profound commerce between philosophical and psychological ideas in theories of mental health and disease. This will be done in part by a consideration of some conceptual developments in the history of psychiatry, as well as through an analysis of some of the functions of the notions of mental illness and health. He does not give his prescriptions until he has won the patient's support, and when he has done so, he steadilY aims at producing complete restoration to health by persuading the sufferer in to compliance (Laws 4. 720 b-e, [28]). This passage shows the perennial nature (...) of the problems of treating the patient as a person. It shows as well the historical'depth of philosophical interest in medicine. The history of philosophy includes more reflections upon medical ethics than the casual reader might suspect. Many of these reflections are pertinent to contemporary issues such as abortion and population control. Plato, for example, recommends abortion in cases of incest (Republic 5. 461c); and Aristotle argues for letting seriously deformed children die, while forbidding infanticide as a means of popUlation control, suggesting instead the use of early abortions. 'As to the exposure in rearing of children, let there be a law that no deformed child shall live, but that on the ground of an excess in the number of children... let abortion be procured before sense and life have begun; what mayor may not be lawfully done in these cases depends on the question of life and sensation' (Politics VII, 16,335 b20-26, [4]). This is the inauguratory volume of a new series in philosophy and medicine. The papers are the proceedings of the first trans-disciplinary symposium on philosophy and medicine held at the University of Texas Medical Branch, 1974. These essays are uniformly good, and they provide a necessary starting point for anyone wishing to do serious reflection in this area. None make the exaggerated claim that there is a philosophy of medicine, but rather, (...) they take the unique nature of medicine, as the locus of science, practical art, and morality, to be an extraordinarily rich area for philosophical reflection. Thus the assumption is that not only may philosophy serve medicine, but medicine may provide some valuable insights with respect to how philosophy may be done. (shrink)

BackgroundThe ageing of the population and the increased number of chronic diseases are associated with an increased frequency of end of life care in hospital settings. Residents rotating in hospital wards play a major part in their care, regardless of their specialty. General practitioner (GP) residents are confronted to such activities in hospital settings during their training. Our aim was to know how they feel about taking care of dying patients, as end-of-life care are very different from the clinical activity (...) they are trained to.MethodsWe surveyed all GP trainees of “Ile de France”. The survey was made of 41 questions regarding advanced directives divided in 7 sections about patients’ care, communication, mentoring and repercussion on personal life. The survey was done one time, during two pre-specified days.Results525 residents (53.8%) accepted to fulfill the survey. 74.1% of the residents thought that palliative care could have been better. Possible ways of improvements were: a reduction of unreasonable obstinacy (or therapeutic overkill, two terms defined in French law as curative treatment without reasonable hope of efficiency) (59.6%), patient’s (210 answers, 40%) and relative’s communication (information of patients and relatives about the severity of the disease and risk of death) (199 answers 37.9%). Residents also reported a lack of knowledge regarding end-of-life care specific treatments (411 answers, 79.3%) and 298 (47.2%) wished for better mentoring. Those difficulties were associated with repercussion on their private life (353 answers, 67.2%), particularly with their close relatives (55.4%). Finally, 56.2% of trainees thought that a systematic psychologic follow up should be instituted for those working in “at risk” hospital settings.ConclusionSelf-perception management of dying patients by GP resident emphasize their lack of training and supervision. The feeling of suboptimal care is associated with consequences on personal life. (shrink)

This symposium contains a selection of the papers that were presented at a conference we organized on Rational Choice and Philosophy that was held at Vanderbilt University on 16 and 17 May 2014. The aim of the conference was to provide an inter-disciplinary forum for philosophical work that uses ideas and tools from rational choice theory, understood broadly to include decision theory, game theory and social choice theory.

As a model for processing information about people's perceptions to understand the complex world and society in which they live, the cultural schema serves as a key concept in Cultural Linguistics when directing to the perception and processing of information about people, and social groups, and events. Cultural schema theory is valuable in deciphering culturally structured concepts, covering the entire range of human experience expressed in many fields such as education, belief, religion, etc. Through the practice of sacred rituals, each (...) religious believer can form his system of ideas about entities in his or her belief world. Those experiences and experiences are conceptualized through the language picture. In the process of cultural development and integration, the cultural awareness of the Catholic community also reflects certain changes in Catholicism in the West in harmony with the customs and beliefs of Eastern countries. like Vietnam, expressed through the practice of funeral rites and traditional marriage of the Vietnamese. In this article, by using quantitative and qualitative methods, we have conducted a character analysis of the above cultural schemas based on the corpus of 120 discourses drawn during the implementation perform funeral and marriage rites for Vietnamese Catholics. Research results show that cultural schemas (event diagrams, role schemas, image schemas, propositional schemas, and emotional schemas) reflect the cultural knowledge (beliefs, standards, principles, and expectations) of each Vietnamese Catholic about DEATH and MARRIAGE as a journey or a new transformation in one's life... That is the basis for them to transmit achieve and explain the basic values of these two concepts, helping us to understand more deeply the mind of the Vietnamese Catholic community in Vietnam when performing two important rituals in human life in reality. Since Sir Archie Cochrane’s seminal Nuffield Provincial Hospitals Trust lectures in 1972 and their publication as the Rock Carling monograph for that year, Effectiveness and Efficiency: Random Reflections on Health Services, the idea that medical interventions and health services should be evaluated and selected on the basis of (...) the most reliable evidence available for their effectiveness and cost effectiveness has become very widely accepted.1,2 This widespread acceptance has not been complete, and it sometimes seems that there are as many critics of EBM as advocates. In Norway, by tradition a Lutheran country, the puritan ethics of a moral minority has a strong influence on the development and manifestations of medical ethics. Those who exert this influence are found primarily among politicians, the clergy, and, last but certainly not least, among nurses and doctors. The focus of interest is not so much on problems of bioethical moral theory or the teaching of bioethics to students, but very much on attitudes and policies with regard to substantive issues (...) traditionally regarded in Norway as burning bioethical issues, such as: medical research ethics, abortion, prenatal diagnosis, euthanasia, definitions of death, and reproductive technologies. UTILIZING MICHEL FOUCAULT'S CONCEPTION OF "PLAGUE" AS A DESCRIPtion of states of exception, this essay analyzes America's plans to genetically screen illegal immigrants. It argues that liberal democratic theory presupposes the exceptionalism of the nation-state and hence justifies sacrifices to appease the tragic order of things. The use of genetic technology in current American immigration policy instantiates these "necessary" sacrifices, extending agency and visibility in a never-ending struggle to foreclose every manner of contingency. In contrast, I offer a "doxological" view (...) of space that, eschewing this tragic economy, re-imagines the world by resisting foreclosure and "laboring" to remain open. After theorizing the genetic screening of illegal immigrants through Foucault's "plague" and Hans Jonas' work on sacrifice, I articulate the globalized nation-state as the exception for violence and conclude with political theology's more capacious view of space and cultural identity. The so-called “conciliatory” norm in epistemology and meta-ethics requires that an agent, upon encountering peer disagreement with her judgment, lower her confidence about that judgment. But whether agents actually abide by this norm is unclear. Although confidence is excessively researched in the empirical sciences, possible effects of disagreement on confidence have been understudied. Here, we target this lacuna, reporting a study that measured confidence about moral beliefs before and after exposure to moral discourse about a controversial issue. Our findings indicate (...) that participants do not abide by the conciliatory norm. Neither do they conform to a rival “steadfast” norm that demands their confidence to remain the same. Instead, moral discourse seems to boost confidence. Interestingly, we also find a confidence boost for factual beliefs, and a correlation between the extremity of moral views and confidence. One possible explanation of our findings is that when engaging in moral discourse participants become more extreme in their opinions, which leads them to become more confident about them, or vice versa: they become more confident and in turn more extreme. Although our work provides initial evidence for the former mechanism, further research is needed for a better understanding of confidence and moral discourse. (shrink)

This paper focuses on learning that takes place outside formal classrooms within groups or teams. Based on the conceptual framework of informal learning, adult learning and lifelong learning, it investigates how two contrasting groups of adult learners in Vietnam, Mekong doctors and Hanoi hairdressers, learn, interact, and collaborate through their informal learning experiences in the workplace. These are two ‘co-present groups’ or two ‘complex systems’. For Vietnamese learners, the challenges of Confucian heritage culture, or the lack of awareness of cultural (...) differences, created obstacles to collaboration and participation. The contribution to this Special Issue argues that co-present group learning applies well to non-Western Confucius-based cultures and other countries with similar values, despite this lack of awareness of cultural differences. The first step in reasoning about actions and change involves reasoning about how the world would evolve if a certain action is executed in a certain state. Most research on this assumes the evolution to be only a single step and focus on formulating the transition function that defines changes between states due to actions. In this paper we consider cases where the evolution is more than just a single change between one state and another. The first part of a symposium devoted to Alex Broadbent's essay titled ‘Prediction, Understanding and Medicine’, this article notes the under-development of a variety of issues in the philosophy of medicine that transcend bioethics and the long-standing debates about the nature of health/illness and of evidence-based medicine. It also indicates the importance of drawing on non-Western, and particularly African, traditions in addressing these largely metaphysical and epistemological matters.

The Congregation for the Doctrine of the Faith, under the prefecture of Joseph Ratzinger, published its instruction Donum vitae in 1987 to provide moral guidance on bioethical issues. Since 1987, many new ethical issues have arisen, especially in the areas of regenerative medicine (which includes stem cellresearch) and assisted reproduction. To address these the CDF, under the prefecture of William Levada, published the bioethical instruction Dignitas personae inDecember 2008. Contemporary casuistry, informed by a centuries-old intellectual tradition within the Jesuit order of the Catholic Church, characteristically maintains that ethical judgment does not rely on abstract laws, general rules or universal principles. Ethical judgment is formed through a subtle activity of comparing prior, settled cases with the current problem one is experiencing. Judgment on moral matters is therefore thought to be highly context-dependent and requires a sensitivity to the unique facts and social circumstances of each case. This discussion reviews the (...) origins of casuistry within Jesuit thought and then examines the implications of casuistry for organizational ethics. Our central argument is that contemporary casuistry, while correct to emphasize the particularity of ethical judgment, is nonetheless compatible with an important role for general principles in ethical decision-making within organizations. In this article, we are exploring a methodological approach to research on faith and religious expressions in urban Africa. We are committed to trans-disciplinary work that pursues research methods mutually liberating for researchers, co-researchers and community participants and that results in long-term benefits and strengthened agency on the part of the host communities. Our reflections in this article are based on a collaborative research project1 in two regions of Pretoria, Tshwane2 – Pretoria Central and Mamelodi East – in (...) which we explore how religious innovation and competition in and amongst churches contribute to the healing or perpetuation of urban fractures. This introductory piece provides context for this symposium on Richard Shusterman's new book, Philosophy and the Art of Writing. The piece reflects on the symposium genre from Plato's classic dialogue to its form today. It claims that Shusterman's work asks us to take this kind of philosophical writing more seriously, and for that reason the symposium itself has taken on a different structure. The piece discusses how each of the contributors responding to the book (with Shusterman (...) leading the way), Eli Kramer, Randall Auxier, and Charles Johnson, have engaged in practicing, nurturing, and supporting broad modes of philosophical writing, and in turn why they have chosen to do so in this context. This statement summarizes the conclusions of the Symposium on the Definition of Death, held at The Catholic University of America in June 2014. After providing the background and context for contemporary debates about brain death and describing the aims of the symposium, the statement notes points of unanimous and broad agreement among the participants, and highlights areas for further study.

Case law retrieval is the task of locating truly relevant legal cases given an input query case. Unlike information retrieval for general texts, this task is more complex with two phases (legal case retrieval and legal case entailment) and much harder due to a number of reasons. First, both the query and candidate cases are long documents consisting of several paragraphs. This makes it difficult to model with representation learning that usually has restriction on input length. Second, the concept of (...) relevancy in this domain is defined based on the legal relation that goes beyond the lexical or topical relevance. This is a real challenge because normal text matching will not work. Third, building a large and accurate legal case dataset requires a lot of effort and expertise. This is obviously an obstacle to creating enough data for training deep retrieval models. In this paper, we propose a novel approach called supporting model that can deal with both phases. The underlying idea is the case–case supporting relation and the paragraph–paragraph as well as the decision-paragraph matching strategy. In addition, we propose a method to automatically create a large weak-labeling dataset to overcome the lack of data. The experiments showed that our solution has achieved the state-of-the-art results for both case retrieval and case entailment phases. (shrink)

In 2012, the symposium "Christopher Boorse and the Philosophy of Medicine" was held at the University of Hamburg. The initial ideas presented at this event, which celebrated Chris's contribution to the development of what is now a vibrant area of research, especially to the theory of disease, form the core of the papers published in this issue. Similarly to what Robert Nozick once said about John Rawls's work, it can be demanded that philosophers of medicine must (...) now either work within Boorse's theory or explain why not. It is simply the main contender in the so-called naturalist camp of contributions to the theory of disease. All of the papers in this issue address his approach in some respect, and all of them are friendly toward his theory up to a point. In this brief introduction, I try to extract common threads. In doing so, I focus on three issues that have the capacity to determine future debates. The first is the methodology of developing a theory of disease, especially what conceptual analysis amounts to and what it may achieve. The second is the issue of value-ladenness of the concepts of health and disease, a topic that has been at the forefront of the philosophical debate, but which -- to my mind -- has often been misunderstood. The third issue is the problem of the unity of medical terminology. We can ask whether there is only one core medical concept, be it "disease," "pathology," "disorder," "malady," or something else. Alternatively, we might propose different concepts for different purposes. (shrink)

This article investigates five kinds of vagueness in medicine: disciplinary, ontological, conceptual, epistemic, and vagueness with respect to descriptive-prescriptive connections. First, medicine is a discipline with unclear borders, as it builds on a wide range of other disciplines and subjects. Second, medicine deals with many indistinct phenomena resulting in borderline cases. Third, medicine uses a variety of vague concepts, making it unclear which situations, conditions, and processes that fall under them. Fourth, medicine is based (...) on and produces uncertain knowledge and evidence. Fifth, vagueness emerges in medicine as a result of a wide range of fact-value-interactions. The various kinds of vagueness in medicine can explain many of the basic challenges of modern medicine, such as overdiagnosis, underdiagnosis, and medicalization. Even more, it illustrates how complex and challenging the field of medicine is, but also how important contributions from the philosophy can be for the practice of medicine. By clarifying and, where possible, reducing or limiting vagueness, philosophy can help improving care. Reducing the various types of vagueness can improve clinical decision-making, informing individuals, and health policy making. (shrink)

Does the ability of some brain dead bodies to maintain homeostasis with the help of artificial life support actually imply that those bodies are living human organisms? Or might it be possible that a brain dead body on life support is a mere collection of still-living cells, organs and tissues which can coordinate with one another, but which lack the genuine integration that is the hallmark of a unified human organism as a whole? To foster further study of these difficult (...) and timely questions, a Symposium on the Definition of Death was held at The Catholic University of America in June 2014. The Symposium brought together scholars from a variety of disciplines—law, medicine, biology, philosophy and theology—who all share a commitment to the dead donor rule and to a biological definition of death, but who have differing opinions regarding the validity of neurological criteria for human death. Explores some steps toward non-assimilative encounters in the "global village.".

Participatory processes are often intended to encourage inclusion of multiple perspectives in defining management means and goals. However, ideas about the legitimacy of certain uses and users of the resources can often lead to exclusion from participation. In this way, participation can be transformed from a process of inclusion of various resource users to one of exclusion. Using a case study from a marine protected area in Loreto, Baja California Sur, Mexico, and drawing on work in deliberative democracy, I present (...) a typology of how individuals and groups can be excluded from participation. External exclusion includes non-invitation and other means for keeping participation from occurring. Internal exclusion refers to exclusionary events during participatory meetings. This analysis suggests that participation needs to be recognized as a valuable but easily manipulated tool in the design of projects like natural resource management. (shrink)

Legal text retrieval serves as a key component in a wide range of legal text processing tasks such as legal question answering, legal case entailment, and statute law retrieval. The performance of legal text retrieval depends, to a large extent, on the representation of text, both query and legal documents. Based on good representations, a legal text retrieval model can effectively match the query to its relevant documents. Because legal documents often contain long articles and only some parts are relevant (...) to queries, it is quite a challenge for existing models to represent such documents. In this paper, we study the use of attentive neural network-based text representation for statute law document retrieval. We propose a general approach using deep neural networks with attention mechanisms. Based on it, we develop two hierarchical architectures with sparse attention to represent long sentences and articles, and we name them Attentive CNN and Paraformer. The methods are evaluated on datasets of different sizes and characteristics in English, Japanese, and Vietnamese. Experimental results show that: (i) Attentive neural methods substantially outperform non-neural methods in terms of retrieval performance across datasets and languages; (ii) Pretrained transformer-based models achieve better accuracy on small datasets at the cost of high computational complexity while lighter weight Attentive CNN achieves better accuracy on large datasets; and (iii) Our proposed Paraformer outperforms state-of-the-art methods on COLIEE dataset, achieving the highest recall and F2 scores in the top-N retrieval task.
